Terms of Service

1. Acceptance of Terms
By accessing or using Firedesk ("Service"), operated by Firedesk ("Company," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
Firedesk is a cloud-based fire department management platform that provides incident reporting, apparatus tracking, truck checks, training management, compliance tools, and related features. The Service is provided on a subscription basis.
3. Accounts and Registration
To use the Service, your department must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
4. Subscriptions and Payment
Paid plans are billed in advance on a monthly or annual basis through our payment processor, Paddle. By subscribing to a paid plan, you authorize us to charge your payment method at the applicable rate. Prices are subject to change with 30 days' notice.
5. Free Trial
We may offer a free trial period. At the end of the trial, your account will transition to the Free plan unless you subscribe to a paid plan. We reserve the right to modify or discontinue trials at any time.
6. Cancellation and Refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until then. The current billing period is non-refundable. Please see our Refund Policy for full details.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to store or transmit malicious code
- Resell or redistribute access to the Service without authorization
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of the data you submit to the Service. We will not access your data except as necessary to provide the Service, comply with the law, or enforce these Terms.
9. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Firedesk and is protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.
11. Limitation of Liability
To the maximum extent permitted by law, Firedesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or goodwill. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Indemnification
You agree to indemnify, defend, and hold harmless Firedesk and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Termination
We may suspend or terminate your access to the Service at any time for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable rules.
